There are many affluent communities in Massachusetts whose residents misunderstand or are unfamiliar with the term affordable housing. Affordable housing covers a wide range of affordable housing possibilities including rentals and for sale property.
Massachusetts General Law 40B (MGL 40B), also known as the Anti-Snob Zoning Act was enacted in 1969. 40B is also known as the Comprehensive Permit Statute.
What does it do? It encourages cities, towns, and contractors to construct affordable housing through a locally granted permit procedure.
The purpose of affordable housing under 40B is to address the significant shortage of affordable housing across the state. The now fifty-year-old law reduces any and all unnecessary barriers that exist or may be created by a municipality’s approval process.
This process is usually overseen by a zoning board. The comprehensive permit covered by 40B is what is referred to as an all-encompassing permit, which absorbs all permits and their approvals. These permits are generally issued by other boards within the city or town government.
In short, a 40B permit allows developers to build at a higher density than is normally allowed under a town or city’s zoning laws. This law enables the Zoning Board of Appeals (ZBA), who may consult with other boards or officials to grant a single permit to the developer who is pursuing the ability to develop low-or moderate-income housing.
40B, as a law, requires that Massachusetts communities use a streamlined review process to develop affordable housing.
